As a witness, you have an important part to play in telling the court what you know.

You must answer all questions truthfully and as accurately as you can. You will be asked to take an oath to tell the truth or make an affirmation to do this before you begin your evidence.

Witnesses stand when giving evidence. If this would be difficult for you, ask the Judge if you can sit down.

You will be asked questions about the case by:

• the fiscal who represents the prosecution
• the defence lawyer (or lawyers if there is more than one accused)

Sometimes the judge may also ask you questions

Some tips

If you are nervous about giving evidence, it might help to:

• listen carefully to what you are asked
• take your time to answer
• say if you do not understand or do not know the answer
• speak slowly and clearly

After you give evidence

The judge will tell you when you are free to go after you have given evidence. You can stay and listen to the rest of the case if you wish.

You must not return to the witness room after giving evidence in court or discuss your evidence with other witnesses who have still to give their evidence.
