Trespass (Scotland) Act 1865 (R013239)

Thank you for your request dated 26 May 2016 under the Freedom of Information (Scotland) Act 2002 (FOISA) for how many people have been charged, and how many convicted of criminal trespass under the Trespass (Scotland) Act 1865 in the past 20 years.

We advised you by e-mail of 27 May 2016 that the earliest information we could provide was for the financial year 2002-03 and you confirmed you were content with that.

I attach a table below which contains the number of charges which have been reported to COPFS under the Trespass (Scotland) Act 1865 since the financial year 2002-03 and the number of convictions which have been obtained on those charges. Please note that not all charges  reported to COPFS will be prosecuted for a variety of reasons.  It should also be noted that some of the cases, especially for financial years 2013/14 and 2015/16 will still be ongoing.

I should advise that COPFS case management database is a live, operating database. It is designed to meet our business needs in relation to the processing of criminal cases, and the information within it is structured accordingly. We do not have a separate statistical database, and hold only operational data needed for business purposes. 

It should be noted that the information provided relates to charges received and one or more charges may relate to the same person.
