Thank you for your request dated 2 June 2016 under the Freedom of Information (Scotland) Act 2002 (FOISA) for the undernoted information:

1) I would like to know how many people have been prosecuted in Scotland since 2014 for casting a vote at a local, national, UK and European Parliament election when they did not have the legal right to cast that vote?

2) I would also like to know how many people have been prosecuted in Scotland since 2014 for casting a vote at a local, national, UK and European Parliament election when they did not have the legal right to do so, but they submitted true and factually accurate personal information to the Electoral Register and therefore the crime of “voter impersonation” does not necessarily apply?

In respect of part 1 of your request, I can confirm that COPFS records show that since 2014, no persons have been prosecuted in Scotland for casting a vote at a local, national, UK and European Parliament election when they did not have the legal right to cast that vote.

In respect of Part 2 of your request, I can confirm that COPFS records show that since 2014, no persons have been prosecuted in Scotland for casting a vote at a local, national, UK and European Parliament election when they did not have the legal right to do so, but they submitted true and factually accurate personal information to the Electoral Register and therefore the crime of “voter impersonation” does not necessarily apply.
