Thank you for your request dated 22 June 2016 under the Freedom of Information (Scotland) Act 2002 (FOISA) for the undernoted information:
“To ask the number of people charged with criminal offences in Scotland who have claimed diplomatic immunity.
To ask for details of these alleged offences and the outcome in each case (in terms of whether a prosecution went ahead or PF decided on no action).
I would request this information for each of the last five years (2011 to 2015 inclusive) and for this year so far, if possible, please.”
I can confirm that COPFS only hold information on cases reported to them by the Police and not on the number of people charged with criminal offences in Scotland. Police Scotland may hold the information on the number of persons charged with criminal offences in Scotland who have claimed diplomatic immunity and you may wish to contact them for this information. In respect of cases reported to COPFS in which the accused has claimed diplomatic immunity, I can confirm in terms of Section 17 of FOISA that COPFS does not hold the information you have requested.
Accordingly, I am unable to consider points 2 and 3 of your request.
