Freedom of Information: Part 6 – Marine (Scotland) Act 2010 (R01151) 

Thank you for your request dated 23 October 2015 under the Freedom of Information (Scotland) Act 2002 (FOISA) for the undernoted information:

“Part 6 of the Marine (Scotland) Act 2010 created a licensing scheme, operated by Marine Scotland (i.e. Scottish Ministers), for regulating the shooting of seals in coastal waters.  It was brought into force in January 2011. 

Please provide details, broken down by year since 2011, of:  

(a) the number of offences reported to the Procurator Fiscal
(i) under section 107;
(ii) under section 108(4);
(iii) under section 112(5);
(iv) under section 113(4); and
(v) under section 117;

(b) the number of convictions secured under each of those provisions; and
(c) the sentences in relation to each such conviction.”

As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations.

Having completed a search of our electronic records, I can advise that in respect of Part (a) of your request, no reports have been submitted to the Crown Office and Procurator Fiscal Service for the period you have requested, containing a contravention of the above noted Sections of the Marine (Scotland) Act 2010.

Accordingly, there is no data to consider in respect of Parts (b) and (c) of your request.
