Thank you for your e-mail dated 8 December 2015 in which you seek information about the number of reports received by COPFS for offences under section 39 of the Criminal Justice and Licensing (Scotland) Act 2010, along with number of prosecutions commenced, number of convictions and acquittals, prosecutions ongoing and number of cases discontinued for the year 2014/2015.

We have previously provided you with the information for the years 2010/11, 2011/12, 2012/13 and 2013/14.  That information reflected the position at 5 January 2014

I attach at Annex A the requested information for the year 2014/15.  This information is correct as at 1 October 2015.

I have also provided an explanation of how these figures should be interpreted at Annex B.

Annex B

  • The COPFS electronic case management system is a live system which will change on a daily basis as cases conclude and decisions are taken. The information provided represents the position at the end of the day on 1 October 2015.
  • The information provided represents the number of charges reported to COPFS, not the number of individual reported or the number of reports submitted by the police.
  • The statistics included within the ‘Charges reported to COPFS’ box include charges which were reported to COPFS within 2014/2015. If however a charge was reported to COPFS within 2014/2015 but is still ongoing they will not appear in the ‘Convicted’ or ‘Acquitted’ box but will be recorded in the ‘Proceedings still ongoing’ or ‘Proceedings discontinued’ boxes.
