Thank you for your e-mail of 18 July 2014 in which you refer to a previous request for information received from your colleague. Your comments are being treated as a request for information under the Freedom of Information (Scotland) Act 2002 (FOISA):

"Figures for the number of cases of TV Licence evasion reported to the Procurator Fiscal in Scotland for the calendar years 2010, 2011, 2012, 2013, and 2014 year-to-date.

This information for the period 2010-11 to May 2013-14 is contained in the spreadsheet you provided. Please can you send me updated figures to June 2014?

The number of fiscal fines issued I note that the fiscal fines are represented as a percentage of the Direct Measures issued. As discussed, please can you provide me with the actual figures?

The value of fiscal fines issued

I note that you hold this information but as your case management system is not designed to provide statistical information, the only way to locate and extract this would involve manually checking case files. Please can you provide me with a little more detail about what locating and retrieving the information will entail and an estimate of how much information you would be able to provide within the appropriate limit?

The number of convictions

The number of cases marked "No Proceedings" for the period cited above

Your view was that the Crown Office does not hold official figures for the above and that these may be published by the Judicial Office for Scotland. Please can you confirm this and signpost me to where I may be able to secure the information?"

  • The number of TV Licensing cases reported to COPFS updated to June 2014;
  • Figures for the number of fiscal fines issued;

  • The number of cases where No Action was taken.

You may wish to note that while we have provided figures in response to your request our case management system is not designed to provide statistical information. It is a live, operating database and the information contained within it is structured accordingly. While we have provided you with the information held on our systems at this time, this information may as a result be subject to change as our systems are updated for operational reasons for example if a fiscal fine was later refused or withdrawn or a case marked for court proceedings was discontinued. For this reason the data contained within this table will differ from and will supersede the data in the table previously provided to your colleague. For the same reason it is appropriate that I advise you to refer your request for information regarding prosecutions and convictions to the Scottish Government. Statistical information can be extracted more easily from the Scottish Government Justice Department’s Court Proceedings Database which is designed to provide statistical information.
