Freedom of Information: Stalking Cases (R008987 and R009802)

Thank you for your request dated 22 October 2014 under the Freedom of Information (Scotland) Act 2002 (FOISA) for updated information about the number of reports received by COPFS for offences under section 39 of the Criminal Justice and Licensing (Scotland) Act 2010, along with number of prosecutions commenced, number of convictions and acquittals, prosecutions ongoing and number of cases discontinued.


As you are aware, the information held by the Crown Office and Procurator Fiscal Service (COPFS) which falls within the ambit of your request in relation to offences under Section 39 of the Criminal Justice and Licensing (Scotland) Act 2010 (offence of stalking) has already been published for financial years 2010/11, 2011/12, 2012/13 and 2013/14 (to 12 September 2013).  The information is published on our web-site and is accessible using the link below.

I attach below the requested information for the complete financial year 2013/14 and the financial year 2014/15 (to 9 October 2014).  This information is correct as at 9 October 2014 and includes charges reported for the period up to 30 September 2014.

As with the previous published response, all of the data corresponds with the financial year in which the charge was raised e.g. convictions for charges raised in 2013-14 are recorded in the 2013-14 data though the conviction may not have occurred during that period. The number of prosecutions ongoing should be taken into account in interpreting the figures, particularly where there are a significant number of prosecutions which have not yet concluded. The total number of charges reported will also include charges where action was taken in relation to other charges reported in the case, for example, because the prosecutor took the view that an alternative charge was more appropriate or because details of the charge were included within the body of another charge for evidential reasons.
