Freedom of Information Request: Prosecution statistics under the Offensive Behaviour at Football and Threatening Communications (Scotland) Act 2012

Thank you for your e-mail dated 23 April 2013 under the Freedom of Information (Scotland) Act 2002 (FOISA) in which you seek the following information:

“Can you please provide the following volumes in relation to prosecutions under section 1 of the Offensive Behaviour at Football and Threatening Communications (Scotland) Act 2012.

 

    

     1. The number people charged
         And then of the number of people charged:


     2. Cases closed before prosecution (including cases where defendant
         was prosecuted under different legislation)

     3. Cases yet to be prosecuted (but still open)

     4. Cases where active court proceedings are ongoing

     5. Cases which resulted in a guilty plea

     6. Cases where defendant was found guilty following a not guilty

     plea

     7. Cases where defendant was not guilty/acquitted following a

     guilty plea”



It may help to explain that COPFS uses a live operational case management system, specifically designed to receive criminal and death reports from the police and other specialist reporting agencies and to manage the cases for prosecution purposes.  The information held on the system is structured for these operational needs, rather than for statistical reporting or research purposes.

The information which is available is given in the table below. This relates to the position as at 31 December 2012.

You may wish to be aware that updated figures, covering charges reported up to 31 March 2013 will be published on 14 June on the COPFS website.
