Freedom of Information Request: Hate Crime Statistics

Thank you for your e-mail of 17 June 2013 addressed to the Justice Statistics mailbox in which you requested information under the Freedom of Information (Scotland) Act 2002 (FOISA). As this information is held by the Crown Office and Procurator Fiscal Service (COPFS) it has been passed to the COPFS Customer Care Unit to reply. You requested the following information:

1) "I noticed that the hate crime figures for 2012-13 have been published and was wondering whether the race crime figures are to be made available by council areas as in the past?"

2) "I was also wondering whether the breakdown of hate crime by the different categories - disabled, sexual orientation, etc. - will also be available at a council level?"

3) "Is the Rutherglen-Cambuslang area part of South Lanarkshire in Glasgow (as it sometimes is for other data) or with the rest of South Lanarkshire?"

I have addressed these requests below.

1) I note from your email of 25 June 2013 to my colleague, that you no longer wish any additional information on offences aggravated by religion or race. We have therefore treated this part of your request as withdrawn and this information will not be provided to you.

2) It may assist to explain that Crown Office and Procurator Fiscal Service (COPFS) uses a live operational case management system, specifically designed to receive criminal and death reports from the police and other specialist reporting agencies and to manage the cases for prosecution purposes. The information held on the system is structured for these operational needs, rather than for statistical reporting or research purposes.

Table 1 (annexed) shows a breakdown of the 2012-2013 'Hate Crime in Scotland' statistics (link attached below) by Procurator Fiscal Office, not including information on offences aggravated by race or religion. Information is also provided regarding which council area the jurisdiction of each Procurator Fiscal office falls within. It should be noted this particular part of the information provided should be treated as an approximation only.

3) The Rutherglen – Cumbuslang area is covered by the Glasgow Procurator Fiscal Office, so is included in the figures for the Glasgow office. As the table shows, Glasgow office's jurisdiction covers parts of three local authority areas (Glasgow City, East Dunbartonshire and South Lanarkshire).
