Thank you for your e-mail of 23 July 2013 under the Freedom of Information (Scotland) Act 2002 (FOISA) in which you seek the following information -

"1.1) How many crime reports have been filed by the British Transport Police to a PF regarding a sexual assault on trains in Scotland, for the periods between:


a) 2008 and 2009,

b) 2009 and 2010,

c) 2010 and 2011,

d) 2011 and 2012,

e) 2012 and 2013;

f) 2013 to date.

Could you please provide a breakdown of the figures as per the dates noted above.

1.2) Of these reports, could you please note also how many involved an allegation of sexual assault having taken place inside a toilet or, more specifically, inside a disabled toilet, and the year to which the allegation related.

1.3) For each crime report filed to a PF, could you please indicate the outcome of the reported case?

2.1) How many crime reports have been filed by the British Transport Police to a PF regarding a rape on trains in Scotland, for the periods between:

a) 2008 and 2009,

b) 2009 and 2010,

c) 2010 and 2011,

d) 2011 and 2012,

e) 2012 and 2013;

f) 2013 to date.

Could you please provide a breakdown of the figures as per the dates noted above.

2.2) Of these reports, could you please note also how many involved an allegation of a rape having taken place inside a toilet or, more specifically, inside a disabled toilet, and the year to which the allegation related.

4.3) For each crime report filed to a PF, could you please indicate the outcome of reported case?"

It may assist to explain that Crown Office and Procurator Fiscal Service (COPFS) uses a live operational case management system, specifically designed to receive criminal and death reports from the police and other specialist reporting agencies and to manage the cases for prosecution purposes. The information held on the system is structured for these operational needs, rather than for statistical reporting or research purposes.

The information that you have requested is attached at Annex A. The information provided shows the number of reports COPFS has received from the British Transport Police over the specified period relating to sexual assaults and rapes committed on trains. This information also shows whether these reported offences occurred on the Edinburgh to Glasgow train line or whether they were allegedly commited in a train toilet. The information provided also shows the outcome of the decisions taken by the Procurator Fiscal having considered these police reports. I can advise you that no action was taken in four of the cases referred to as there was insufficient admissible evidence.
