Freedom of Information Request: HATE CRIME – 2012 – 2013

Thank you for your e-mail of 14 June and your further e-mail dated 15 June in which you requested the following information under the Freedom of Information (Scotland) Act 2002 (FOISA):

"Any information that would show that the data in the 'Hate Crime in Scotland 2012-13' document was independently verified by a non-government or non judicial body"

I can advise you that the data within that publication was not independently verified by a non-governmental or non-judicial body therefore the information you have requested is not held in terms of section 17 of FOISA.

I can, however, refer you to the last page of the ‘Hate Crime in Scotland 2012-13’. This publication is an Official Statistics Publication for Scotland as is therefore subject to the Code of Practice for Official Statistics. Further information can be found with in this document.

  •  For the past five years, up to the end of 2012/13 (ie March 31, 2013), a list, year-by-year, of the numbers of compensation/damages claims against the Crown Office and Procurator Fiscal Service for alleged wrongful arrest of witnesses or victims of crimes/alleged crimes, due to applications - by fiscals, advocate deputes, or representatives of the Crown - to courts for arrest warrants.

Thank you for your request dated 4 June 2013 under the Freedom of Information (Scotland) Act 2002 (FOISA) for "figures for the prosecution and conviction for offences related to prostitution in Scotland for the past 10 years. ie sale of sex, kerb crawling and the running of a brothel. Please detail the names of the relevant offences."

We have now completed our search for the information you request, and a copy is enclosed at Annex A.

For background we have also included a breakdown of the prosecutions still ongoing at the time the data was extracted.

Thank you for your e-mail dated 4 June in which you asked for the following information under the Freedom of Information (Scotland) Act 2002:

  1. The number of cases in each of the last five years where the Crown have ordered or permitted the retention of a body part or organ of a person.
  2. The number of instances in each of the last five years where a family or next of kin of a person whose body part or organ was retained was not informed of their options (to postpone a funeral until the part is released, to have the part cremated at a later date or to donate the part to medical science) before the funeral or cremation was held.
  3. Details of Crown Office action to deal with the issue of retained body parts and organs in the last two years.
