Thank you for your request 21 January 2013 (received in our Paisley office on 24 January) under the Freedom of Information (Scotland) Act 2002 (FOISA), in which you requested "How many persons were prosecuted for committing offences under Section 170 of the Road Traffic Act 1988? Please give me the figure for latest twelve month period you have reasonably available for your District."

It may help to explain that COPFS uses a live operational case management system, specifically designed to receive criminal and death reports from the police and other specialist reporting agencies and to manage the cases for prosecution purposes. The information held on the system is structured for these operational needs, rather than for statistical reporting or research purposes.

The information you have requested relates to the jurisdiction of the Paisley courts - and a total of 136 offences were reported under Section 170 of the Act in the financial year 2011-12. Of these, 70 were prosecuted on indictment or on a summary complaint. There are a variety of different reasons why cases are not prosecuted. The most common reason that these types of offences are not prosecuted is where there is insufficient admissible evidence to prove the charge in court.
