Freedom of Information: Cycling on Footpath (Grampian)

Thank you for your letter dated 9 November 2012 under the Freedom of Information (Scotland) Act 2002 (FOISA) in which you seek statistics for cyclists in the Grampian area who have been convicted in the past year of an offence under the Roads (Scotland) Act 1984, Section 129 in respect of cycling on the footpath.


The Crown Office and Procurator Fiscal Service (COPFS) uses a live, operational case management system, specifically designed to receive criminal and death reports from the police and other specialist reporting agencies and to manage the cases for prosecution purposes. The information held on the system is structured for these operational needs, rather than for statistical reporting or research purposes.

In the last 3 years, one such offence was reported to COPFS in the Grampian area and the decision for that case was to issue a fixed penalty.
