How many prosecutions for Housing (Scotland) Act 2006 S28(1) - Fail to comply with a repairing standard enforcement order (R015680)

Thank you for your email of 22 March where you requested clarification on the following information under the Freedom of Information (Scotland) Act 2002 (FOISA):

  • How many prosecutions have been taken in each of the last three years against landlords who fail to comply with a Repairing Standard Enforcement Order put on a property by The Private Rented Housing Panel (now The Housing and Property Chamber, First Tier Tribunal for Scotland). In the event a landlord fails to comply with this order it is a criminal offence.
  • It would be helpful if the number of prosecutions in each local authority area could be shown if possible

It is designed to meet our business needs in relation to the processing of criminal cases, and the information within it is structured accordingly. We do not have a separate database, and hold only operational data needed for business purposes.

In regards to your first request, in the table below we have provided any charges for Housing (Scotland) Act 2006 S28(1), that were prosecuted in the last three financial years. As these relate to charges, this could mean that one or more of the charges could relate to the same person or case.

In regards to your second request, we are unable to provide this by local authority order, but I have provided the Procurator Fiscal’s office to which the charges were submitted.
