Civil Recovery Reports for 2014- 2016 (R015706)

Thank you for your request dated 27 March 2017 under the Freedom of Information (Scotland) Act 2002 (FOISA) for the undernoted information:

“Your website gives one the impression the COPFS has not published any Civil Recovery Unit Annual Reports since its 4th one which covered the period from 1 April 2013 to 31 March 2014 http://www.crownoffice.gov.uk/media-site/statistics#Civil_recovery
My freedom of information request relates to these.
If the reports are produced but not published to the public, could I have a copy of those for 2014-15 and 2015-16 please? 
Alternatively, if they are NOT published but it is still possible for COPFS to gather the statistics found within such a report, could you please send me the: 

  • Total amounts remitted by the Civil Recovery Unit (CRU) of the COPFS to the Scottish Consolidated Fund per annumer of Cash referrals to the Civil Recovery Unit of the COPFS per annum
  • Number of Cases referred to UK Taxation Authorities  (NCA HMRC) by the COPFS per annum
  • Number of Disclosure Notices served by the CRU per annum
  • Number of Production orders served by the CRU per annum
  • Number of Asset Recovery referrals to the CRU per annum
for the financial years 2014-2015 and 2015-16.”


Civil recovery is dealt with by the Civil Recovery Unit (CRU), a constitutionally distinct unit acting as sole agents for the Scottish Ministers to carry out civil investigations and litigation under Part 5 of the Proceeds of Crime Act 2002 (POCA).

The Civil Recovery Unit (CRU) acts on behalf of the Scottish Ministers as the enforcement authority for Scotland under Part 5 of the Proceeds of Crime Act 2002.  CRU functions under the 2002 Act can be divided into two areas: asset recovery and cash forfeiture.  Cash forfeiture cases only are heard in the Sheriff Court.  Other assets are dealt with by proceedings raised in the Court of Session

Annual reports are not held for the financial years 2014/15 and 2015/16, but I attach at Annex A a table providing the information requested.
