European Arrest Warrants (R015983)

Thank you for your request dated 29 April 2017 under the Freedom of Information (Scotland) Act 2002 (FOISA) for the undernoted information:

1. Number of European Arrest Warrants issued by COPFS in 2015 and 2016. Please provide details on the offences and EU country involved.

2. Number of EAWs issued by other EU states that were sent to COPFS/Police Scotland to execute, in 2015 and 2016. Please provide details on the offences and EU country involved.

3. Number of EAWs that were applied for by Police Scotland/other police forces but were ultimately rejected by the COPFS in 2015 and 2016. Please provide details on the reason for rejection (e.g. not complying with applicable laws/regulations, procedural errors etc.)

As you will be aware, the European Arrest Warrant was introduced into United Kingdom Law on 1 January 2004 with the coming into force of the Extradition Act 2003. Please find responses to your queries below.

3. In Scotland, EAWs are not requested by Police Scotland or any other police force. Where an EAW is sought, the relevant Procurator Fiscal or Department of COPFS dealing with the case will consult with COPFS International Co-operation Unit. The EAW is then prepared, signed by a Sheriff at Edinburgh Sheriff Court and issued via the National Crime Agency. As such, the specific information you requested in terms of EAWs requested by Police Scotland in the years specified and those turned down by COPFS does not exist as it does not reflect the process followed.
