Football Liaison Prosecutors – (R016044) June 2017

Thank you for your request dated 11 May 2017 under the Freedom of Information (Scotland) Act 2002 (FOISA) for the undernoted information:

a. how many Football Liaison Prosecutor posts there are currently;

b. the level of seniority of these posts (e.g. deputy, senior or principal Procurator Fiscal Depute,

c. the salary range for full-time posts at that level (for each year since the posts were created),

d. whether the current FLPs are full-time or part-time and (e) when the FLPs took up post.

A Football Liaison Prosecutor (FLP) is not a separate post within COPFS. The FLP is an additional prosecutorial role. Prosecutors perform the role of FLP in addition to their existing duties. The FLP role has been in existence since August 2011.

The role of the FLP is outlined in the Lord Advocate’s Guidelines on the Offensive Behaviour at Football and Threatening Communications (Scotland) Act 2012 which is published on the COPFS website at:

There are currently seven Procurator Fiscal Deputes performing the FLP role throughout Scotland.

The salary ranges for a Procurator Fiscal Depute since 2011 are noted below:

2011/12 – £39,000-£46,365

2012/13 - £39,000-£46,365

2013/14 - £39,000-£46,829

2014/15 - £39,000-£47,297

2015/16 - £39,000-£47,770

2016/17 - £41,312-£48,248

I consider the information on whether the current FLPs are full time or part time and when they took up their roles to be exempt from release under section 38(1)(b) of the Freedom of Information (Scotland) Act 2002 (FOISA). This exemption applies because the information is personal data of a third party and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This is an absolute exemption and is not subject to the public interest test.
