The number of FOISA request made and the number not answered since they began (R016878) Oct 2017

Thank you for your letter of 1 September 2017 where you requested the following information under the Freedom of Information (Scotland) Act 2002 (FOISA):

1) The Number of Freedom of Information requests made since records began by year

2) The number of Freedom of Information request made since records began, by year that you did not answer that request made

FOISA came into force on 1 January 2005 and initially COPFS recorded these on a calendar year basis. In 2013, this changed to collating the figures by financial year and these figures are set out in the attached table in annex A.

As COPFS does respond to all valid FOI requests, I have interpreted the second part of your request to mean the number of FOI requests where we have not provided the requested information in the response.

It may assist you to explain that information may not be provided for a number of reasons. The most common reasons for not providing information are that we do not hold the requested information, or that it would cost an excessive amount to provide the information. In addition, we may consider applicable exemptions under FOISA where appropriate.

We may not provide information where requests were not valid, repeated, vexatious, withdrawn, or where clarification was requested and not received.
