The document provides guidance on the factors that must be considered when considering prosecution of persons who are, or may be, refugees, recognising the the principle in Article 31 of the Refugee Convention, which provides protection for refugees and presumptive refugees.

It covers principles which should be applied, detailed considerations and factors, offences that Section 31 applies to, public interest considerations, application of the policy to non-refugees/asylum seekers, and burden and standard of proof.
