FAI Determination published following Glencoe deaths

The Crown Office and Procurator Fiscal Service (COPFS) notes the publication of the determination in the Fatal Accident Inquiry into the deaths of David Fowler, Graham Cox, and Hazel Crombie.

David Fowler, 39. Graham Cox, 60, and Hazel Crombie, 64, died after a fall while roped together on the Aonach Eagach ridge, Glencoe, on 5 August 2023. 

Unlike a criminal trial, an FAI seeks to establish the facts surrounding the death and is not a hearing which apportions blame.       

The purpose of an inquiry is to establish the circumstances of the death and to consider what steps, if any, may be taken to prevent other deaths in similar circumstances.       

The Procurator Fiscal, who acts in the public interest, led expert evidence on the facts and circumstances of the deaths at the FAI in which other interested parties were represented.    

Following the publication of the determination, Procurator Fiscal Andy Shanks, who leads on fatalities investigations for COPFS said:      

“The tragic deaths of David Fowler, Graham Cox, and Hazel Crombie sadly highlight the inherent risks of mountaineering. 

“The FAI followed a thorough and comprehensive investigation by the Procurator Fiscal who ensured that the full facts and circumstances of these tragic deaths were presented in evidence. 

“The sheriff’s detailed findings note areas of concern which the mountain guiding community should consider when booking and preparing for excursions 

“The Determination has been provided to the families and our thoughts are with them at this time.”  

Further information

The inquiry was discretionary in relation to the deaths of Graham Cox, and Hazel Crombie and mandatory in relation to the death of David Fowler as his death occurred while in the course of his employment.
