On 21 May 2020 guidance was issued that stipulated all Covid-19 or presumed Covid-19 deaths where the deceased was resident in a care home when the virus was contracted should be reported to COPFS.

On 21 May 2020 guidance was issued that stipulated all Covid-19 or presumed Covid-19 deaths where the deceased might have contracted the virus in the course of their
employment or occupation should be reported to COPFS.

& 4 The guidance of 21 May 2020 applied retrospectively. The National Records of Scotland shows it will apply to the deaths of 1,942 people who died in care homes. COPFS is aware of these deaths and they stand to be reported in due course as part of a co-ordinated multi-agency approach.

All deaths in custody are reported to COPFS, irrespective of the presence or suspected presence of Covid-19.

Other categories of deaths that require to be reported to COPFS are explained here
